Regulations of the Music School "Meluzyna"

1. General provisions

1.1. These Regulations define the rules for providing educational services by the music school Meluzyna, operated by the Artistic Agency LoungeArt Malina Kęsicka, ul. Zana 7, 20-601 Lublin, NIP 712 232 85 73, REGON 43251799, hereinafter referred to as the "School".

1.2. Each participant of the classes (or their legal representative in the case of a minor), by accepting these Regulations, enters into a contract for the provision of educational services with the School.

1.3. In matters not regulated by these Regulations, the provisions of the Civil Code and the Act on Providing Services by Electronic Means shall apply.

2. Type and scope of services

2.1. The School offers individual music lessons, including instruction in playing instruments and voice training.

2.2. Registrations are made through the online form (ActiveNow).

2.3. Payments can be made by bank transfer or online (PayU/ActiveNow).

3. Conditions for providing services electronically

3.1. To use online registrations and payments, the following is required:

  • access to the Internet,
  • an up-to-date web browser,
  • an active email account.

3.2. The School may temporarily limit access to the reservation and payment system due to maintenance or failure.

4. Conditions for concluding and terminating contracts

4.1. The contract between the participant and the School is concluded upon acceptance of the Regulations in the online form.

4.2. In the case of a contract concluded via the online form, the consumer has the right to withdraw from the contract without giving a reason within 14 days from the date of its conclusion. To meet the deadline, it is sufficient to send a statement before its expiry. If, at the express request of the consumer, the classes begin before the expiry of this period, in the event of withdrawal from the contract, the consumer is obliged to pay for the classes conducted until the moment of withdrawal, proportionally to the extent of the service provided. The template for the withdrawal form constitutes Annex No. 1 to the Regulations, made available as a separate file for download on the School's website.

4.3. Resignation from classes after the withdrawal period requires written or email form.

4.4. A one-month notice period applies, counted from the day the resignation is received.

5. Organization of classes

5.1. Classes are held individually, according to the established schedule.

5.2. Absences must be reported in the ActiveNow system, by email, or by phone at least 24 hours before the classes. Absences should not be reported to the teacher.

5.3. Each student is entitled to cancel classes free of charge 24 hours before the scheduled lesson twice per semester. There is an option to make up for such classes on the day the teacher is available or to cancel the payment.

5.4. Once per semester, each student has the right to cancel one lesson without adhering to the 24-hour notice and without the need to pay for the classes. Such absence must be reported by phone or via SMS to the number 601 926 909; it cannot be reported through the app.

5.5. Classes canceled by the teacher will be made up at another time, on the day the teacher is available. If there are no available dates, the fee for the unfulfilled classes will be canceled.

5.6. In the case of an unreported absence or the use of the allowed absence limit, the classes are considered completed and are subject to full payment.

6. Fees and payments

6.1. Payments are made:

  • by transfer to the School's account: 50 1020 5558 1111 1159 4220 0024,
  • online through the ActiveNow system (PayU).

6.2. Fees are paid in advance – monthly by the 10th day of the month or according to the established schedule.

6.3. Failure to make timely payment may result in suspension of participation in classes.

7. Complaints

7.1. Participants have the right to submit complaints regarding the services:

  • by email to the School's address,
  • in writing at the headquarters.

7.2. Complaints are processed within 14 days of their submission, and the response is provided on a durable medium (email/paper).

8. Privacy policy and personal data protection

8.1. The administrator of personal data is the Artistic Agency LoungeArt Malina Kęsicka, ul. Zana 7, 20-601 Lublin, NIP 712 232 85 73.

8.2. Personal data is processed for the purpose of:

  • providing educational services,
  • conducting registrations and payments,
  • organizational contact.

8.3. The legal basis for data processing is Article 6(1)(a) and (b) of the GDPR.

8.4. Each participant has the right to access their data, rectify, delete, restrict processing, and object.

8.5. Providing data is voluntary but necessary for participation in classes.

9. Safety and responsibility for the child

9.1. The parent/legal guardian is responsible for safely bringing the child to the classes and picking them up after the classes.

9.2. The School supervises the child only during the classes. Before and after the classes, the responsibility for the child rests with the parent/legal guardian.

10. Final provisions

10.1. The School reserves the right to change the Regulations with a 14-day notice.

10.2. The current version of the Regulations is available at the headquarters and on the School's website.

10.3. Matters not regulated are subject to the provisions of the Civil Code, the Act on Providing Services by Electronic Means, and – to the extent applicable – the Act of May 30, 2014, on Consumer Rights.
